The document, applicable law, and receiving organization determine whether witnesses are required and how they must participate.
A document witness generally observes a person sign and then signs the document as evidence of that observation. The exact duty can vary. Some witnesses may need to hear a declaration, confirm the signer appears willing and aware, sign in a particular order, provide an address, or complete another statement on the document.
The notary has a separate role. The notary identifies the principal, confirms the conditions for the requested notarial act, administers an oath or takes an acknowledgment when applicable, and completes the notarial certificate. A notary seal does not replace a required witness signature, and a witness signature does not replace notarization.
Not every document needs witnesses. Requirements may come from the document itself, applicable law, a bank, title company, health-care organization, court, school, agency, or another receiving party. SafeNotarize does not decide whether a witness is legally required and cannot guarantee that a specific witness arrangement will be accepted.
